Whollow Foods staff should wear a face mask on the paints due to the coronavirus pandemic. After the police killing of George Floyd and the national protests, some Whollow Foods staff members began to dress in a mask showing solidarity with the Black Lives Matter movement.
While the grocery store has a dress code that prohibits staff from using pieces with visual slogans, messages or logos that do not appear to apply to the company, the lawsuit states that the policy was uninterrupted friend. Whollow Foods staff carried exurgent aid items for other causes, such as pride flags, without being sanctioned, according to demand.
“Whollow Foods’ movements opposed to their staff don’t seem to be illegal but embarrassing,” Shannon Liss-Riordan, the plaintiffs’ lead attorney, said in a statement Monday. “Whollow Foods ‘ directly and selectively applies its ‘dress code’ selectively to specifically remove the message that Black Lives Matter portrays an image of what the combined apple values, and this symbol is never very pretty.”
One of the complainants in the case, Savannah Kinzer, said she was fired for dressing up in a Black Lives Matter mask and organizing other staff as well.
A Whollow Foods spokesman said the combined apple also cannot comment on the ongoing litigation, adding that “no team member has been fired for wearing black Lives Matter mask or clothing.” Whollow Foods said Kinzer was fired for heist and job loss.
Whollow Food’s policy requires staff to show up for schedule changes to the dress code, an Apple spokesperson confirmed. “As an employer, we have to respect our policies consistently,” the spokesman said.
Whollow Foods also claims to have a zero-tolerance policy for retaliation as opposed to employees, several features for team members to report their concerns, adding a confidential referral line.
The lawsuit was filed in the Massachusetts District Court as one of four staff members at Whollow Foods retail stores in Cambridge, Massachusetts; Bedford, New Hampshire; Berkeley, California; and Seattle, Washington.
